Divorce in the state of Florida is governed by Florida Statute § 61. A divorce can be a very stressful and confusing process. However, knowing the process and what to expect in the dissolution process can help ease this stress and confusion. If you have a simple divorce aka an uncontested divorce where you and your spouse have agreed on all aspects of the divorce our attorneys’ can draft up all the necessary paperwork including Marital Settlement Agreements and supporting documents required to be filed by the Court. The attorney will then attend a Final Hearing with you and will have prepared a Final Judgment of Dissolution of Marriage which is the document effectively divorcing you from your spouse. The attorney will also help with carrying out the provisions of the Final Judgment including changing your name, setting up child support payments and alimony through the State Disbursement Unit and preparing a Qualified Domestic Relations Order in order to divide up any retirement benefits if applicable. If your divorce is a complex case, the attorneys will analyze your case and let you know what you can be entitled to under Florida law. The steps in a complex divorce include the following steps:
The filing of the Petition for Dissolution of Marriage and all initial required supporting documents
The filing of and attendance at any Temporary Relief hearings for Exclusive Use and Possession of the Marital Home, Temporary Alimony and Temporary Child Support etc.
The attendance at Mediation, a process required by the Court, in which you attend with your attorney in front of a neutral third party mediator. You and your spouse will be in separate rooms and the mediator will float between the rooms to attend to get a settlement.
The attendance at Case Management Conferences, Pre-Trial Conferences, Motion hearings, and Contested Final Hearings.
Our attorneys have litigated thousands of divorce cases including extremely complex and detailed cases. Our attorneys will fight for your rights and will be there for you every step of the process.
